Terms and Conditions

Contract :

The Contract for a short-term holiday let at The Old Byre, Blarmachfoldach, Fort William shall be between the client and Joan Campbell and shall be governed by Scottish Law. Once any required initial deposit or credit card details have been received and confirmation issued on behalf of Joan Campbell the contract shall be considered to be legally binding on both parties. The contract shall be subject to the following booking conditions:

Reservations :
A reservation is confirmed when you have received an email from us that details:
The date of arrival and departure and the tariff.
That any deposit required has been paid.

Payment :
No deposit is required for The Old Byre if the reservation is made more than 8 weeks prior to commencement of the holiday rental expect for bookings as specified below. A credit card will be requested to secure your booking. If the booking is made for periods of more than 1 week made more than 6 month in advance for peak season weeks and for bookings for Christmas and New Year there will be a non-refundable deposit of £150.

The balance of the holiday rental is payable 8 weeks prior to the arrival date.

Where a booking is confirmed less than 8 weeks prior to arrival payment must be made in full. Payment may be made by BACS  bank transfer, by cheque (UK Sterling) or by Credit/Debit Card.

Care of the Property :
The client will be responsible for ensuring that the conditions of let are adhered to and is legally bound to notify Joan Campbell of any breakages or damage to the property and to reimburse them for replacement, repair or extra cleaning costs on demand. The client shall take all reasonable and proper care of the property and its contents and shall leave them in the same state of repair and clean and tidy condition at the end of the period of rental as provided at the beginning.

Excess cleaning charge.
The client has a commitment to take care of the property during their stay and to leave it in a reasonable condition on departure. It is also your agreement to pay for any breakages for which you are responsible. Should any specialist cleaning be required after the tenancy, or any breakages are evident, the cost of this will be charged to the credit card that was used to confirm the reservation.

CANCELLATION POLICY

If You wish to cancel Your booking, You agree to notify us of this in writing at the earliest available opportunity.

    • You acknowledge that if You cancel Your booking, the following charges will apply:
    • Notice of cancellation: More than 8 weeks’ notice – no charge.
    • A booking made for periods of more than 1 week made more than 6 month in advance for peak season weeks there will be a non-refundable deposit of £150.
    • NOTE: With the following, we will make every effort to re-let the dates cancelled. If we are successful in re-letting then a refund will be made less £75 to cover re-advertising, credit cards and admin fees. 
    • Notice of cancellation: Less than 8 weeks’ notice (including failure to check in and early departures) – Your Booking Deposit and Final Payment will not be refunded.
    • Insurance: 
      We strongly recommend that you take out adequate holiday insurance to cover any costs you might incur if you have to cancel your holiday, as We do not provide any insurance under the terms of your holiday rental agreement. (For instance www.cancellationplan.com for UK holiday insurance; this company is not affiliated with Us and many other insurers are available).

Force majeure :
We cannot accept responsibility or pay any compensation where the performance or prompt performance of our contract with you is prevented or affected by reason of circumstances which amount to “force majeure”

Circumstances amounting to “force majeure” include any event which we or the owner(s) could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of the property (which cannot reasonably be remedied to a satisfactory standard before the start of your holiday) through fire, flood, explosion, storm or other weather damage, break-in, criminal damage or any similar event beyond our or the owner’s control. Such circumstances also include riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity and all similar situations beyond our control.

Personal Property :
Personal property is your own responsibility. Vehicles are left at your own risk.

Period of Let :
The period of let runs from 4 pm on the day of arrival and terminates at 10:00am on the day of departure.

Age of guests :

The Old Byre is suitable for adults only. The design and furnishing of our cottage is not suitable for children or babies and they cannot be accommodated at the property.

Pets :
Strictly No Pets

Smoking :
Strictly No Smoking

Conditions of Let :
The Old Byre is to be used for the purpose of  a holiday let only and is not an assured tenancy under the terms of the Housing (Scotland) Act 1988. You therefore only have the right to occupy the property for the agreed period of rental for holiday purposes only in terms of Schedule 4 of the aforementioned Act.

We reserve the right to refuse entry to anyone who, in our opinion, is not suitable to take occupation of the property. In such cases all payments shall be refunded and the contract terminated without further liability.

We also reserve the right to terminate the Contract at any time or remove any persons due to unreasonable behaviour, damage to property or causing annoyance or offence to other parties. In such cases any refund shall be at the discretion of Joan Campbell or her representative.

If for any reason the accommodation is not available on the confirmed booking dates due to events beyond our reasonable control all monies paid will be refunded. Joan Campbell will have no further liability to you or any other party.

Number of Persons in the property :
The number of persons occupying the property during the period of holiday let shall not exceed two guests as designated on our website and the reservation confirmation.

Complaints :
Should you have any cause for complaint during the period of holiday let this should be brought to our attention as soon as possible.

Right of Entry :
Joan Campbell or a representative shall be given right of access to the property at all reasonable times for the purposes or repair and maintenance or routine inspection.

Terms & Conditions :
Joan Campbell reserves the right to change or amend the terms and conditions at any time.
